1. Acceptance of Terms
By downloading, installing, accessing, or using the Personal Budget mobile application ("Application", "App") or associated website, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not install or use the Application.
These Terms constitute a legally binding agreement between you ("User", "you") and AvidCo ("we", "us", "our").
2. Important Financial Advice Disclaimer
Personal Budget is strictly a self-help personal expense recording, calculation, and organizational tool. AvidCo is not a registered financial advisor, wealth manager, accountant, tax consultant, or credit provider. The calculation outputs, projections, monthly rollover balances, and statistics generated by the App are provided solely for general informational and educational convenience. You are solely responsible for all personal financial decisions, investments, savings allocations, and budgeting strategies.
3. License & Intellectual Property
Subject to your compliance with these Terms, AvidCo grants you a personal, non-exclusive, non-transferable, revocable license to download, install, and execute Personal Budget on personal mobile devices under your control.
All trademarks, service marks, application code, visual interfaces, graphics, icons, algorithms, and documentation are the exclusive intellectual property of AvidCo and are protected by South African and international copyright, trademark, and intellectual property laws.
4. Acceptable Use
You agree that you will not:
- Decompile, reverse engineer, disassemble, or attempt to derive the source code of the App, except to the extent permitted by mandatory applicable law.
- Redistribute, rent, lease, sublicense, loan, or commercially exploit the App without prior written consent from AvidCo.
- Attempt to circumvent security protections, licensing verifications, or ad-removal verification mechanisms.
5. In-App Purchases & Billing
Personal Budget offers an optional one-time in-app purchase to remove advertisements and unlock lifetime ad-free usage:
- Payment Execution: All in-app transactions are conducted through Google Play In-App Billing (for Google Play installations) or Huawei In-App Purchases / IAP (for Huawei AppGallery installations).
- Refund Policies: Refund requests are governed by the respective store guidelines of Google Play or Huawei AppGallery. Because the purchase grants immediate lifetime benefits, AvidCo does not directly process monetary refunds outside of standard store dispute mechanisms.
- License Restoration: You may restore your lifetime ad-free purchase on any supported device linked to your original Google Play or Huawei ID.
6. Local Data Storage & User Responsibility
Because Personal Budget is built on a local-first architecture, all budget months, categories, expenses, and savings goals are stored directly in your phone's internal storage sandbox:
- You acknowledge that AvidCo does not maintain remote cloud copies of your budget data.
- If you lose your device, damage the hardware, clear application storage, or uninstall the App without having created an external backup (such as device-level Android backups), your budget records may be irretrievable. AvidCo is not liable for data loss caused by hardware failure, operating system resets, or user deletion.
7. Disclaimer of Warranties
THE APPLICATION IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. AVIDCO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
We do not warrant that the App will meet your specific accounting needs, that SMS detection regex will recognize every bank notification format in all world territories, or that operation will be uninterrupted or error-free.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL AVIDCO, ITS DIRECTORS, EMPLOYEES, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, SAVINGS, BUSINESS INTERRUPTION, LOSS OF DATA, OR FINANCIAL DISCREPANCIES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE APPLICATION.
9. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without giving effect to any principles of conflicts of law. You agree to submit to the jurisdiction of the courts of South Africa for the resolution of any dispute arising under these Terms.
10. Modifications & Updates
AvidCo reserves the right to modify or replace these Terms at any time. We will update the "Effective Date" at the top of this document whenever changes occur. Continued use of the Application after changes are posted constitutes your acceptance of the revised Terms.
